With this privacy policy we inform you about the scope of the processing of your personal data (hereinafter "data") on our website at www.vidjet.io. This policy does not apply to linked websites that are not owned and controlled by Vidjet. If you are using our Services such as Vidjet`s video player, please refer to our Data Processing Addendum.

In principle, we will only use your personal data in accordance with the applicable data protection laws, in particular the Spanish Data Protection and Digital Rights Act 3/2018 (DPA), the General Data Protection Regulation (GDPR), and only as described in this privacy policy. 

Personal data is any information relating to personal or material circumstances that relates to an identified or identifiable individual. This includes, for example, your name, date of birth, e-mail address, postal address, or telephone number as well as online identifiers such as your IP address. In contrast, information of a general nature that cannot be used to determine your identity is not personal data. This includes, for example, the number of users of a website. However, we reserve the right to put this data to additional uses to the extent permitted or required by law or necessary to support legal or criminal investigations. In this case, we will inform you again about this further data processing to the extent required by law and obtain your consent.

General information on data processing
In the course of our business and website operations, we process data. This also includes disclosure by transmission to third parties and, where applicable, to so-called third countries outside Spain and the EEA. Where we transfer data outside Spain or EEA, we have highlighted this accordingly below.

Data processing
The individual data concerned, processing purposes, legal bases, recipients and, where applicable, transfers to third countries are listed below:

a) Hosting
To provide our website, we use the services of Amazon AWS EC2 Infrastructure provided Amazon Web Services (AWS) EMEA Sarl of One Burlington Plaza, Burlington Road, Dublin 4, Ireland. who process the below-mentioned data and all data to be processed in connection with the operation of this website on our behalf.  The legal basis for the data processing is our legitimate interest in providing our website in accordance with Art. 6 para. 1 f) GDPR.

b) Log file during website visit
We log your website visit. In doing so, we process:
- Name(s) of our accessed web site(s),
- date and time of the access,
- the amount of data transferred,
- the browser type and version,
- the operating system you use,
- the referrer URL (the previously visited web site),
- your IP address,
- the requesting provider.

The legal basis for data processing is our legitimate interest in the ongoing provision and security of our website in accordance with Art. 6 (1) f GDPR. The log file is deleted after seven days, unless it is needed to prove or clarify specific legal violations that have become known within the retention period.

c) Contacting us
If you contact us, we process the following data from you for the purpose of processing and handling your enquiry: Name, contact details -if provided by you- and your message.

The legal basis of the data processing is our obligation to fulfil the contract and/or to fulfil our pre-contractual obligations in accordance with Art. 6 (1) b) GDPR and/or our legitimate interest in processing your enquiry in accordance with Art. 6 (1) f) GDPR.

d) Messenger
If you contact us via the chat, the personal data transmitted by you will be stored automatically. Such personal data transmitted to us on a voluntary basis by you will be stored for the purpose of processing your request or contacting you. We use the services of Intercom of the Intercom R&D Unlimited Company, a company registered in Ireland with a registered address at 2nd Floor, Stephen Court, 18-21 Saint Stephen's Green, Dublin 2; Intercom, Inc. a Delaware corporation with offices at 55 2nd Street, 4th Fl., San Francisco, CA 94105, USA, on our website. Further information on data protection can be found at https://www.intercom.com/legal/privacy. We have no knowledge of the storage period at Intercom and no possibility to influence it. 

The processing of data provided is carried out in accordance with Art. 6 para. 1 p. 1 lit. b) GDPR, which authorises the processing of data for the performance of a contract or pre-contractual measures. Furthermore, Art. 6 para. 1 p. 1 lit. f) GDPR authorises us to process data in order to safeguard our legitimate interests.

e) Contract fulfilment and data management in the context of the Vidjet services
We process various data within the framework of the provision of our services and for the initiation and processing of the existing contractual relationship between you and us. This may include your e-mail, images, and videos of yourself or other you upload, contact details you disclose and any other data you are voluntarily providing when signing up and testing, or using our services. We also process your billing, payment, and other data relevant to your subscription when you purchase our services. As well as some Client information you provide when integrating our services in your website. For further information about the use of your Client data by us please refer to our Data Processing Addendum.

Accordingly, the data is processed on the basis of Art. 6 (1) b) GDPR as well as to fulfil our legal obligations pursuant to Art. 6 (1) c) GDPR.

f) Administration, financial accounting, office organisation, contact management.
We process data in the context of administrative tasks as well as organisation of our operations, financial accounting, affiliate program and compliance with legal obligations, such as archiving. In this regard, we process the same data that we process in the course of providing our contractual services. The processing bases are Article 6 (1) (c) GDPR, Article 6 (1) (f) GDPR. Customers, interested parties, business partners and website visitors are affected by the processing. The purpose and our interest in the processing lies in the administration, financial accounting, office organisation, archiving of data, i.e., tasks that serve the maintenance of our business activities, performance of our tasks and provision of our services. The deletion of data with regard to contractual services and contractual communication corresponds to the data mentioned in these processing activities.

In this context, we disclose or transfer data to the tax authorities, consultants, such as tax advisors or auditors, as well as other fee offices and payment service providers.

Furthermore, based on our business interests, we store information on suppliers and other business partners, e.g., for the purpose of contacting them at a later date. This data, most of which is company-related, is generally stored permanently.

g) Technical services
We process the data of our customers in order to enable them to select, purchase or commission the selected services. The required information is identified as such in the context of the order, purchase order or comparable contract conclusion and includes the information required for the provision of services and billing as well as contact information. The legal bases are contractual performance and pre-contractual inquiries on the basis of Art. 6 (1) b) GDPR, legal obligation on the basis of Art. 6 (1) c) GDPR, and our legitimate interests on the basis of Art. 6 (1) f) GDPR. For further information please refer to our Data Processing Addendum.

h) Partnership program
If you register for our Partnership program, we will request mandatory and, where applicable, non-mandatory data in accordance with our registration form for the purposes stated below. The entry of your data is encrypted so that third parties cannot read your data when it is entered. The basis for this storage is the provision of a contract. Your data will remain stored for as long as the registration lasts, in particular the storage is still necessary for the fulfilment/execution of the referral contract, on the basis of Art. 6 (1) b) GDPR or for our other legitimate interests on the basis of Art. 6 (1) f) GDPR or we are required by law to retain your data (e.g., within the framework of tax retention periods) on the basis of Art. 6 (1) c) GDPR.

i)  Use of cookies
We use so-called cookies on our web site. Cookies are small text files that are stored on your respective device (PC, smartphone, tablet, etc.) and saved by your browser. For further information please refer to our Cookie Policy. The legal basis for the use of cookies is your consent in accordance with Art. 6 para. 1 a) GDPR as well as our legitimate interest in accordance with Art. 6 para. 1 f) GDPR.

j) Careers and Applications
If you apply for a role or job, we process the information we receive from you as part of the application process, e.g., through your letter of application, CV, references, correspondence, telephone, or verbal details. In addition to your contact details, information about your education, qualifications, work experience and skills is particularly relevant to us. 
Your data will initially be processed solely for the purpose of carrying out the application process. If your application is successful, it will become part of your personnel file and will be used to carry out and terminate your employment and will be deleted in accordance with the rules applicable to personnel files. If we are unable to offer you employment, we will continue to process your data for up to six months after sending the rejection in order to defend ourselves against any legal claims, in particular alleged discrimination in the application process.


The legal basis for processing data during the application process is Art. 6 para. 1 lit. b) GDPR and, if you have given your consent, for example by sending us information that is not necessary for the application process, it is Art. 6 para. 1 lit. a) GDPR. The legal basis for data processing after a rejection is Art. 6 para. 1 lit. f) GDPR. 

As a rule, we do not require any special categories of personal data within the meaning of Art. 9 GDPR for the application process. We ask you not to provide us with any such information from the outset. If such information is relevant to the application process, we process it together with your other data. Your data will not be used by us for automated decision-making or profiling, nor will it be passed on to third parties. Your data will be processed by us or on our behalf.

You are not obliged to provide us with personal data. However, we can only assess your suitability for the respective position under consideration if we receive information in particular about your education, work experience and skills, and we cannot include you in the application process without providing your contact details.


Analysis / Tracking
a) Google Analytics
We use Google Analytics, a service provided by provided by Google Inc of 1600 Amphitheatre Parkway Mountain View, CA 94043, US. This means that the data collected can in principle be transmitted to a Google server in the USA, whereby the IP addresses are anonymised by means of IP anonymisation so that an allocation is not possible. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. You can object to the collection and processing of this data by Google Analytics by setting an opt-out cookie that prevents the future collection of your data when you visit this website: http://tools.google.com/dlpage/gaoptout?hl=en. The legal basis for this processing is Art. 6 para. 1 letter f) GDPR, our legitimate interest. The use of Google Analytics is based on your consent according to Art. 6 (1) (a) GDPR.

b) Facebook Remarketing
Within our website, so-called "Facebook pixels" of the social network Facebook, which is operated by Meta Platforms Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or if you are a resident of the EU, Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland ("Facebook"), are used. With the help of the Facebook pixel, it is possible for Facebook to determine the visitors to our offer as a target group for the display of advertisements, so-called "Facebook ads". Accordingly, we use the Facebook pixel to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our website. This means that with the help of the Facebook pixel we want to ensure that our Facebook ads correspond to the potential interest of the users and do not have a harassing effect. With the help of the Facebook pixel, we can also track the effectiveness of the Facebook ads for statistical and market research purposes by seeing whether users were redirected to our website after clicking on a Facebook ad.

You can object to the collection by the Facebook pixel and use of your data for the display of Facebook ads. To do so, you can visit the page set up by Facebook and follow the instructions there on the settings for usage-based advertising: https://www.facebook.com/settings?tab=ads  or declare the objection via the US page http://www.aboutads.info/choices/ or the EU page http://www.youronlinechoices.com/. The legal basis for this processing is Art. 6 para. 1 letter f) GDPR, our legitimate interest. The use of Facebook Remarketing is based on your consent according to Art. 6 (1) (a) GDPR.

c) Cookie Consent manager
We have integrated the consent management tool "Cookiebot" from Usercentrics A/S. Usercentrics A/S is registered in Denmark, on our website in order to request consent for data processing or the use of cookies or comparable functions. With the help of "Cookiebot" you have the possibility to give or refuse your consent for certain functionalities of our website, e.g., for the purpose of integrating external elements, integrating streaming content, statistical analysis, coverage measurement and personalised advertising. You can use "Cookiebot" to give or refuse your consent for all functions or to give your consent for individual purposes or individual functions. The settings you have made can also be changed by you afterwards. The purpose of integrating "Cookiebot" is to allow the users of our website to decide on the aforementioned matters and, in the course of further use of our website, to offer them the opportunity to change settings they have already made. In the course of using "Cookiebot", personal data as well as information of the end devices used, such as the IP address, are processed.

The legal basis for the processing is your consent in conjunction with our legitimate interest. Our legitimate interests in the processing lie in the storage of user settings and preferences in relation to the use of cookies and other functionalities. "Cookiebot" stores your data as long as your user settings are active. After two years after the user settings have been made, you will be asked again for your consent. The user settings made will then be stored again for this period.

You can object to the processing. You have the right to object on grounds relating to your particular situation. To object, please contact us.

d) Hotjar
We use Hotjar, a web analytics service provided by Hotjar Ltd, Level 2, St Julian's Business Centre, 3, Elia Zammit Street, St Julian's STJ 1000, Malta ("Hotjar"), to better understand usage patterns, to better understand the needs of our users and to optimize our services and user experience. Hotjar enables us to better understand the user experience on our sites (i.e., how long users spend on which of our sites, which links they click, what they like and dislike, etc.) so that we can tailor our offerings based on user feedback. 

Hotjar uses cookies and other technologies to collect information about user behaviour and user devices (in particular, a device's IP address (which is collected and stored in anonymized form), screen size, device type (unique device identifiers), browser information, geographic information (on a country-by-country basis only), preferred language for viewing our web site). Hotjar stores this data in a pseudonymized user profile. Neither Hotjar nor we will use this information to identify individual users, nor will the data be merged with other data about individual users. You can object to the creation of user profiles, the storage of data about your use of our site by Hotjar, and the use of tracking cookies by Hotjar on other sites at any time by following this link https://www.hotjar.com/opt-out. The use of Hotjar is based on your consent according to Art. 6 (1) (a) GDPR.

e) Hubspot
When you visit certain sections of our website, our partner HubSpot uses cookies for functionality, performance and to track visitors. This cookie is used to keep track of a visitor's identity. This cookie is passed to HubSpot on form submission and used when deduplicating contacts. Please refer to HubSpot`s usage policy for more information. The legal basis for the collection and processing of the data is Art. 6 (1) f GDPR. The legitimate interest in collecting and processing the data is to evaluate your use of the website, to compile reports on website activity and to provide the website operator with other services related to website and internet use. The use of HubSpot is based on your consent according to Art. 6 (1) (a) GDPR.

Duration of data storage
We only store personal data for as long as it is necessary for the purposes for which it is processed or for as long as any consent you have given us has been revoked by you. Insofar as statutory retention obligations must be observed, the storage period for certain data may be up to 6 years, irrespective of the processing purposes.

Transfer of personal data 
Vidjet will not disclose or otherwise distribute your personal data to third parties unless this is necessary for the performance of our services (legal basis for processing: Art. 6 para. 1 lit. b) GDPR), you have consented to the disclosure (legal basis for processing: Art. 6 para. 1 lit. a) GDPR) or the disclosure of data is permitted by relevant legal provisions. 

Vidjet is entitled to outsource the processing of your personal data in whole or in part to external service providers acting as processors for Vidjet pursuant to Art. 4 No. 8 GDPR within the framework of the data protection provisions. External service providers support us, for example, in the technical operation and support of the website, data management, the provision and performance of services, marketing, as well as the implementation and fulfilment of reporting obligations. 

The service providers commissioned by Vidjet process your data exclusively in accordance with our instructions. Vidjet remains responsible for the protection of your data, which is ensured by strict contractual regulations, technical and organisational measures and additional controls by us.

Personal data may also be disclosed to third parties if we are legally obliged to do so e.g., by court order (legal basis for processing: Art. 6 (1) (c) GDPR) or if this is necessary to support criminal or legal investigations or other legal investigations or proceedings at home or abroad or to fulfil Vidjet' legitimate interests (legal basis for processing: Art. 6 (1) (f) GDPR).

Your data subject rights
a) Information
Upon request, we will provide you at any time and free of charge with information about all personal data that we have stored about you.

b) Correction, deletion, restriction of processing (blocking), objection
If you no longer agree with the storage of your personal data or if this data has become incorrect, we will arrange for the deletion or blocking of your data or make the necessary corrections (insofar as this is possible according to the applicable law) on the basis of a corresponding instruction. The same applies if we are only to process data in a restrictive manner in the future. You have the right to object in particular in cases where your data is required for the performance of a task that is in the public interest or in our legitimate interest, as well as profiling based on this. You also have such a right of objection in the event of data processing for the purpose of direct advertising.

c) Right to revoke consent with effect for the future
You may revoke your consent at any time with effect for the future. Your revocation will not affect the lawfulness of the processing up to the time of revocation.

d) Data portability
If data is processed on the basis of a contract, pre-contractual negotiations, consent or with the help of automated procedures, you have the right to data portability. Upon request, we will provide you with your data in a common, structured and machine-readable format so that you can transfer the data to another data controller if you wish.

e) Exercise of your data subject rights and right of appeal
To assert these rights, please contact us. The same applies if you have questions about data processing in our company. You also have the right to lodge a complaint with a data protection supervisory authority. The Spanish Data Protection Agency (AEPD) located at C/Jorge Juan, 6, 28001 Madrid, Spain (www.aepd.es). We would, however, appreciate the chance to deal with your concerns before you approach the AEPD so please contact us in the first instance.

Relevant legal basis
In accordance with Article 13 of the GDPR, we inform you of the legal basis for our data processing. If the legal basis is not stated, the following applies: 
- the legal basis for obtaining consent is Art. 6(1)(a) and Art. 7 GDPR, 
- the legal basis for processing in order to fulfil our services and carry out contractual measures and respond to enquiries is Art. 6(1)(b) GDPR, 
- the legal basis for processing in order to fulfil our legal obligations is Art. 6(1)(c) GDPR, and 
- the legal basis for processing in order to protect our legitimate interests is Art. 6(1)(f) GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Art. 6 (1) (d) GDPR serves as the legal basis.

Automated Decision Making
Automated decision making is not used at Vidjet.

Processing of special categories of data
No special categories of data are processed at Vidjet.

Security
State-of-the-art internet technologies are used to ensure the security of your data. During the online enquiry process, your details are secured with SSL encryption. For secure storage of your data, the systems are protected by firewalls that prevent unauthorised access from outside. In addition, technical and organisational security measures are used to protect the personal data you have provided against accidental or intentional manipulation, loss, destruction or access by unauthorised persons.

Updating your information
If you believe that the information, we hold about you is inaccurate or that we are no longer entitled to use it and want to request its rectification, deletion, or object to its processing, please contact us. For your protection and the protection of all of our users, we may ask you to provide proof of identity before we can answer the above requests.

Keep in mind, we may reject requests for certain reasons, including if the request is unlawful or if it may infringe on trade secrets or intellectual property or the privacy of another user. Also, we may not be able to accommodate certain requests to object to the processing of personal information, notably where such requests would not allow us to provide our service to you anymore.

Links to other providers
Our website also contains - clearly recognisable - links to the websites of other companies. Insofar as there are links to websites of other providers, we have no influence on their contents. Therefore, no guarantee or liability can be assumed for these contents. The respective provider or operator of the pages is always responsible for the content of these pages.

The linked pages were checked for possible legal violations and recognisable infringements at the time of linking. Illegal contents were not recognisable at the time of linking. However, permanent monitoring of the content of the linked pages is not reasonable without concrete indications of a legal violation. Such links will be removed immediately if infringements of the law become known.

Social media
We maintain presences in the "social media". Insofar as we have control over the processing of your data, we ensure that they comply with applicable data protection regulations. However, you use these platforms and their functions on your own responsibility. This applies in particular to the use of the interactive functions (e.g., commenting, sharing, rating). With your consent, data may be transferred to a third country outside the EU, which may have a lower level of data protection than the EU (Art. 49 para. 1 p. 1 lit. a GDPR). We maintain our social media profiles in order to communicate with visitors to these profiles es and to inform them about our offers in this way.

In addition, we collect data for statistical purposes in order to be able to further develop and optimise the content and to make our offer more attractive. The data required for this purpose (e.g., total number of page views, page activities and data provided by visitors, interactions) are processed and made available by the social networks. We have no influence on the generation and presentation of this data.

In addition, your personal data is used by the providers of the social media, but also by us for market research, communication and advertising purposes. It is possible, for example, that usage profiles are created based on your usage behaviour and the resulting interests. This allows, among other things, advertisements to be placed within and outside the platforms that presumably correspond to your interests. Cookies are usually stored on your computer for this purpose. Independently of this, data that is not directly collected from your end devices may also be stored in your usage profiles. The storage and analysis also takes place across devices; this applies in particular, but not exclusively, if you are registered as a member and logged in to the respective platforms.

We do not collect or process any other personal data.

The processing of your personal data by us is based on our legitimate interests in effective information and communication pursuant to Art. 6 (1) sentence 1 lit. f GDPR.

If you are asked for consent to data processing, i.e., if you declare your consent by confirming a button or similar (opt-in), the legal basis of the processing is Art. 6 (1) sentence 1 lit. a., Art. 7 GDPR.

If you are a member of a social network and do not want the network to collect data about you via our website and link it to your stored membership data with the respective network, you must
1) log out of the respective network before visiting our fan page
2) delete the cookies on your device and
3) close and restart your browser

After logging in again, however, you will once more be recognisable to the network as a specific user.

Since we do not have complete access to your personal data, you should contact the providers of the social media directly if you wish to assert your rights, as they each have access to the personal data of their users and can take appropriate measures and provide information.

Personal information and children 
Our services are aimed at people aged 18 and over. We will not knowingly collect, use or disclose personal information from minors under the age of 18 without first obtaining consent from a legal guardian through direct offline contact. 

Changes and updates to the privacy policy
We kindly ask you to regularly inform yourself about the content of our privacy policy. We will amend the privacy policy as soon as changes to the information processing activities we carry out make this necessary. We will inform you as soon as the changes require an act of cooperation on your part (e.g., consent) or other individual notification.
